Can I change my mind after I sign?
Often yes, and the window is short, so read this today rather than tomorrow.
Under Nebraska's Insured Homeowners Protection Act, if you signed a contract for work to be paid out of a property insurance claim, you can cancel until midnight on the third business day after you signed, or after your insurer notifies you in writing that all or part of the claim is not covered, whichever comes later. See Neb. Rev. Stat. 44-8603.
That second half is the part people miss. If your insurer later denies the claim in writing, a fresh cancellation window opens at that point. You are not locked into paying for a roof out of pocket because you signed something three weeks ago expecting insurance to cover it.
How to actually cancel
- Do it in writing. A text or an email is written. A phone call is not.
- Keep your copy, with the date and time.
- Send it before the deadline, not on the day you get around to it.
- Any money you already paid comes back within ten days. The contractor may keep compensation for emergency work already done to prevent further damage, such as tarping. Non-refundable fee clauses in the contract become unenforceable once you cancel.
This right covers insurance funded work. If you are paying for the job yourself, your cancellation rights are whatever the contract says they are. Which is one more reason to read it before you sign it instead of after.
What you should have paid so far
A deposit is normal. Paying for the entire job before anyone shows up is not.
A reasonable structure is a modest deposit so materials can be ordered and you can be scheduled, a payment once the work is substantially complete, and the balance at the end after you have walked it. On insurance work the schedule usually follows how your insurer releases money, which has its own timing.
Be careful about paying large amounts in cash, and pay attention if the number they want up front keeps creeping up. The money still in your pocket is the only real leverage you have if something is not right.
If you are cancelling because of what you were offered
Two offers in particular are worth walking away from regardless of the deadline: a contractor who offers to cover or waive your deductible, which violates Nebraska law, and a form that assigns your insurance benefits to the contractor.
