Can a contractor waive my deductible?

No. In Nebraska it is illegal, and the contractor offering it is telling you something important about how they do business.

After a storm, this is one of the most common things Omaha homeowners get offered at the front door. It comes in a lot of wrappers. We will cover your deductible. We will give you a discount that matches it. We will write it up as an advertising allowance. We will just not charge you for it.

They are all the same thing, and Nebraska law treats them the same way.

Nebraska law

The Insured Homeowners Protection Act prohibits a residential contractor from rebating any part of your insurance deductible in order to win the job, whether it is called a discount, an allowance, a credit, or a rebate. See Neb. Rev. Stat. 44-8604. Violations carry penalties.

Most contractors who offer this are not going to mention the statute. If someone tells you it is standard practice or that everybody does it, you are being told a story by a person who either does not know the law in the state they are working in, or knows it and is betting you do not.

Set the law aside and follow the money

Even if there were no statute, the arithmetic should stop you. Your deductible is a real amount of money. If the contractor is not collecting it from you, it has to come from somewhere.

There is no third option where the money simply appears. When somebody offers to make your deductible disappear, they are describing one of those two things and hoping you do not ask which.

What to do

Walk away, and do not feel rude about it. A contractor who opens with an illegal offer has told you everything you need to know before you have signed anything. That is useful information, and it cost you nothing.

If you already signed something

Nebraska gives you a cancellation right. Under Neb. Rev. Stat. 44-8603, you generally have three business days to cancel a residential contract entered into in connection with an insurance claim for damage. If you signed at the kitchen table two days ago and you are reading this with a bad feeling, that window may still be open. Put your cancellation in writing and keep a copy.

What an honest contractor does instead

They collect your deductible, because that is your part of the contract with your insurance company. They give you an itemized estimate that matches the scope your adjuster approved. If the adjuster missed items, they document those items and request a supplement rather than quietly moving money around.

It is less exciting than being told your deductible vanished. It is also the version where nobody ends up explaining a padded claim with your name on it.
